Creating an Account

To sign up for a WishMerge account, you must be 18 years or older. You hold responsibility for your account and all activity conducted through it. It's possible to browse WishMerge without registering an account but to leverage all of our features, and you'll need to register, select a username, and establish a password. When doing this, ensure that the information you provide us is accurate and comprehensive. Please refrain from impersonating others or choosing names that are offensive or infringe on anyone's rights. If these rules aren't adhered to, we reserve the right to cancel your account. You bear responsibility for all activity on your account and for maintaining the confidentiality of your password. If you discover that your account has been used without your permission, please report it to [email protected]. To register an account, you must be at least 18 years old or old enough to form a binding contract in your jurisdiction. If required, we may request proof of age.

Community Guidelines

At WishMerge, we are committed to creating a safe, inclusive, and respectful community. The guidelines listed below serve as the foundation for our users' behavior within our community. Failure to follow these guidelines may result in consequences including but not limited to warnings, point deductions, account suspension or termination.

1. Respect Each Other

Treat everyone with kindness and respect. No form of harassment, bullying, or discrimination will be tolerated. Any content that promotes violence, hatred, or harm to individuals or groups based on attributes such as race, religion, gender, age, nationality, or sexual orientation is strictly prohibited.

2. Keep It Legal

Don't post or engage in illegal activities. This includes but is not limited to, discussing illegal activities, infringing on copyright or other intellectual property rights, or engaging in fraudulent behavior.

3. Be Genuine

WishMerge is a platform for genuine wishes and authentic interactions. Please refrain from creating fake profiles, manipulating points, or behaving in a way that falsely represents yourself or your wishes.

4. Protect Privacy

Respect your own and others' privacy. Never share personal or sensitive information, including your own or someone else's address, phone number, email address, or financial information.

5. Keep It Clean

All content and language should be suitable for a diverse audience. Avoid posting any content that is violent, graphic, or intended for mature audiences.

6. Stay On Topic

Please keep your interactions and discussions relevant to the platform's purpose - making wishes come true. Off-topic or disruptive content may be removed.

7. Be Constructive

When providing feedback or engaging in discussions, be constructive and respectful. Trolling, flaming, or other disruptive behaviors will not be tolerated.

8. No Spam

Don't post unsolicited or promotional content, repetitive messages, or irrelevant links. Remember, the WishMerge team reserves the right to review and moderate all content, including wishes, comments, profiles, and images. By joining our community, you agree to abide by these guidelines and all other terms of our platform. We appreciate your help in keeping WishMerge a positive and inspiring place to make dreams come true. Limitations of WishMerge's Responsibilities

WishMerge cannot be held liable for any damages or losses linked to your use of our platform. We do not engage in disputes between users or between users and any third party associated with using our services. We do not supervise the accuracy or dependability of wishes or endorse any user-submitted content on the platform. When you utilize the services provided by WishMerge, you absolve us from claims, damages, and demands of every kind — whether they are known or unknown, suspected or unsuspected, disclosed or undisclosed — that may arise from such disputes and the services. All content accessed via our platform is at your own risk. You are solely responsible for any damage or loss to any party. While we aim to foster a secure and enjoyable environment, the execution of wishes and the subsequent transactions and interactions are ultimately at the discretion of the involved users. WishMerge cannot guarantee the realization of every wish or vouch for the quality, safety, or legality of what is offered. Users are encouraged to exercise judgment while interacting on our platform. Our Fees

Registration on WishMerge is free, and creating a wish is also free. We do have a tiered fee structure; however, that applies when your wish successfully receives gifts:

• Level One (Novice Giver): For users at this level, we charge a 15% fee on the total value of the gifts received.
• Level Two (Kind Contributor): The fee drops to 12% for users at this level.
• Level Three (Generous Patron): The fee further reduces to 10% for Advanced users.
• Level Four (Champion Donor): Expert users enjoy a reduced fee of 7%.
• Level Five (Wish Legend): Our most experienced users at this level are charged a minimal fee of 5%.

Please note that making a payment may involve additional fees the payment processor charges.

Affiliate Disclosure

WishMerge participates in the Amazon Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and linking to Amazon.com. When you click on an Amazon product link on our site and make a purchase, WishMerge may earn a commission from that purchase. Please note, this arrangement does not affect the purchase price for you. Our participation in this program is aimed at offering direct links to products that may fulfill the wishes shared by our users, enhancing your experience and the utility of our platform. We commit to transparency with our users regarding our affiliations and advertising practices.

About External Websites and Links

WishMerge may contain links to other websites. For example, wish descriptions, user profiles, and comments may include links to external sites. You do so at your own risk when you access these third-party websites. We don't control or endorse those sites. WishMerge utilizes various payment processing platforms. When you give or receive a gift, you also agree to the payment processor's terms of service.

Our Intellectual Property

• WishMerge's services, content, and marks are legally protected in numerous ways, including under copyright, trademark, service marks, patent, trade secrets, and other U.S. and international intellectual property laws.
• You agree to respect all copyright and other legal notices, information, and restrictions contained in any WishMerge Content, Services, or Marks accessed through the Site or the Services.
• You agree not to modify, translate, or otherwise create derivative works of the Services.
• WishMerge grants you a limited license (which is temporary, non-exclusive, non-sublicensable, and non-transferable) to access and use User Content and WishMerge's Content solely for the use of the Services in accordance with these Terms.
• You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, license, or otherwise transfer or use any User Content or WishMerge Content unless we give you express written permission to do so.
• We reserve the right to revoke this limited license to access and use User Content and WishMerge Content at any time and in our sole discretion.

Your Intellectual Property

• Any royalties or licensing related to your content are your responsibility. You will handle and fulfill all royalties and any other obligations owed to any person or entity based on your content or based on WishMerge's hosting of that content.
• You're responsible for the wishes you post. All information submitted to the platform, whether publicly posted or privately transmitted, is the sole responsibility of the individual from whom that content originated.

Regarding Indemnification

You agree to defend, indemnify, and hold harmless WishMerge, our subsidiaries, and affiliated companies, along with our officers, directors, employees, partners, contractors, representatives, agents, and third-party providers from and against any and all claims, causes of action, damages, obligations, losses, liabilities, costs or debt, and expenses (including reasonable attorneys' fees and costs) and all amounts paid in settlement arising from or relating to breach of these Terms or violation of any applicable laws. We reserve the right, in our sole discretion and at our own expense, to assume the exclusive defense and control of any matter for which you have agreed to indemnify us, and you agree to assist and cooperate with us as reasonably required in the defense or settlement of any such matters.

Dispute Resolution

We at WishMerge encourage you to contact us if you have an issue before taking legal measures. In the unfortunate situation where legal action arises, these Terms (along with all other rules, policies, or guidelines incorporated by reference) will be governed by and construed in accordance with the laws of United States without giving effect to any principles of conflicts of law. International conventions regarding the sale of goods or computer information transactions will not be applied.

Copyright

The Digital Millennium Copyright Act establishes a system of legal prerequisites for handling allegations of copyright infringement. WishMerge complies with the DMCA, and we respond to notices of the alleged infringement if they adhere to the law and the requirements delineated in our Copyright Policy. We reserve the right to remove or disable content alleged to be infringing and to terminate accounts of repeat infringers. We carry out these actions at our sole discretion and when deemed appropriate.

Our Agreement with You

These Terms constitute the entire agreement between You and WishMerge with respect to the Services. They supersede all previous communications, proposals, and agreements (whether oral, written, or electronic) between you and WishMerge regarding the Services and govern our future relationship. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. WishMerge's failure to assert any right or provision under this Agreement shall not constitute a waiver of such right or provision.

Miscellaneous

We reserve the right to modify or discontinue the Services at any time, at our sole discretion. You agree that, except as otherwise expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms. No waiver of any provision of these Terms shall be considered a further or continuing waiver of such term or any other term, and WishMerge’s failure to assert any right or provision under these Terms does not constitute a waiver of such right or provision. You agree that regardless of any statute or law to the contrary, any claim arising out of or related to the Services must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.
